Terms and Conditions of Sale

Pricing

Prices are F.O.B. and are subject to change without notice. All orders are C.O.D. Credit can be arranged after dealing with us for one year and completing our credit application. Interest charges on accounts over 30 days is computed at 2% per month (24% per annum). Accounts over 60 days past due will revert to C.O.D. on future orders. New accounts require 25% deposit on advance orders.

Nursery Hours for Loading

Please call ahead to arrange for pick-up. We are closed Saturdays in the months of January, February, July, August, and December.

Quantity discounts are available

Quoted prices and availability do not mean material is set aside unless firm orders are made. Material ordered or tagged in our yard will be held for 10 days only after notification of it being ready. After 10 days the material will be sold or returned to the yard for general use.

Shipping is at the risk and expense of the purchaser

Once the plants leave our nursery, the customer assumes all responsibility including a tarpaulin to protect the material. If the customer is unable to provide transportation, we will arrange shipment and the customer agrees to pay the freight charges upon delivery.

Sales Tax

We are required by law to collect NJ Sales Tax unless a Resale Certificate (ST-3) or Contractor Exempt Certificate (ST-13) is filed. NJ Landscape Contractors are not exempt and are required to pay NJ Sales Tax.

Complaints

Complaints must be made within 5 days of the invoice date. Purchaser is liable for all freight charges. If any nursery stock is proven to be untrue to variety name under which it was sold, Fernbrook, Inc., shall replace such nursery stock or refund the amount paid. We shall not be held liable for any sum greater than the invoice value at the time of purchase. Fernbrook, Inc. expresses or implies no warranty as to the productiveness or life of nursery stock we sell and will not be held responsible for the results obtained in transplanting.

Summer Digging

All plants can be safely dug during the summer using a 10 day procedure of trenching, watering and using plant hormones. There is an additional 15% charge for this service. Fernbrook, Inc. assumes no responsibility for the survival of summer dug material.
